CONTRACTS WITH HILSDON PHOTOGRAPHY LLC: TERMS AND CONDITIONS:
Unless otherwise stated in writing, the following terms and conditions apply to all contracts with Hilsdon Photography LLC:
Definition of "Contract(s)" as used here: A contract is a legally binding agreement between two or more parties which starts with an offer from one person but which does not become a contract until the other party signifies an unequivocal willingness to accept the terms of that offer. Contracts with Hilsdon Photography LLC are ratified by signatures of both parties to signify agreement and are legally binding.
HILSDON PHOTOGRAPHY LLC: PAYMENT POLICIES: ACCEPTABLE FORMS OF PAYMENT, DEPOSIT REQUIREMENTS, PAYMENT TERMS AND CONDITIONS
1. PAYMENT IN FULL IS DUE AT THE TIME OF SERVICE, LESS YOUR DEPOSIT, FOR ALL NON-COMMERCIAL CONTRACTS. See below for commercial contract conditions.
2. ACCEPTABLE FORMS OF PAYMENT: Hilsdon Photography LLC gladly accepts Cash, all major credit cards (Visa, Master Card and Discover Card) and debit cards with Visa/Master Card logos, and Bank Cashiers checks drawn on U.S. Banks. Personal checks are not accepted.
3. CREDIT CARDS: Hilsdon Photography LLC accepts the following major credit cards: Visa, Mastercard, and Discover. We are unable to accept the American Express card. We also accept Debit Cards with the Visa & Mastercard logo. All credit cards used for our studio services are processed through Authorize.net, via Merchant Focus. Credit cards used for purchasing prints through our website are processed through SmugMug, Inc. our website / secure e-commerce provider. Hilsdon Photography LLC does not physically store customer credit card information on company information systems, computers, or on our web servers. Our website shopping cart is maintained by SmugMug, Inc. and is a secure shopping environment.
PERSONAL CHECK POLICY: It is the policy of Hilsdon Photography LLC not to accept personal checks due to the high risk placed upon the business for fees associated with insufficient funds.
ACCEPTANCE POLICY: BANK CASHIER'S CHECKS AND BUSINESS ACCOUNT CHECKS: Hilsdon Photography LLC gladly accepts Bank cashier's checks, provided they made out to Hilsdon Photography LLC, that are drawn on a bank inside the United States. Checks written on a business account are gladly accepted. Starter business checks are NOT accepted. In the event of insufficient funds or other unforseen problems with your check, Hilsdon Photography LLC will charge an additional $50 administrative fee on top of any bank fees incurred by you as a result of your insufficient funds. You will be responsible for any and all legal fees associated with bringing your account to good standing in the event of insufficent funds, up to and including liability for legal fees or fees associated with debt collections.
REFUND POLICY:
Rescheduling will be offered in the event that we are unable to honor your appointment due to equipment failure or other unforeseen circumstances. Please see your contract with us for full terms and conditions. In the event we are unable to reschedule, a refund limited to the full amount of your deposit will be given.
DEPOSIT REQUIREMENT In all cases, Deposits are NOT refundable, except under specific conditions as set forth in writing below. A non-refundable Deposit of 30% of your total photography services invoice cost will be required when making your appointment. Deposits will be required on a major credit card. Your deposit is non-refundable in the event of a no-show, or a cancellation not covered by the terms below. Deposit will be deducted from your final transaction cost.
CANCELLATION POLICY: 72 Hours notice is required for cancellations. See special note concerning cancellations of commercial, Multi-Day and Weddings contracts.
Special terms and conditions that apply to Commercial, Multi-Day photography contracts: A Non-Refundable Deposit equal to 40% of the total cost is required upon signing your contract with us. Commercial contracts $9999.99 and below are required to pay in full on the day of service (less deposit.) For commercial contracts in excess of $10,000.00, Invoices may be written as Net 10, 20 or 30 Days upon request with a 1.5% discount for early payment. Late Payments on Net 10, 20 or 30 day invoices are subject to a $20 daily late fee until the invoice is paid. Late payment fees go into effect at 00:01 the next calendar day after your invoice deadline has passed. Required deposits for Commercial, Multi-Day photography contracts may be either made by a Business Check drawn on a bank inside the United States, a Bank Cashier's check or secured on a major credit card (Visa/Mastercard/Discover). Two weeks (14 calendar days) notice is required for cancellation of Commercial, Multi-Day photography contracts. Deposits are forefit and will not be refunded in the case of a no-show, cancellation, or a delay caused by customer resulting in Photographer being unable to provide service at the scheduled / alloted time. In the event of extraordinary circumstances or a catastrophic event, those individual circumstances will be reviewed by the business owner on a case-by-case basis. Commercial photoshoots requiring permits for on-location work: It is the policy of Hilsdon Photography LLC to obtain all required permits and property owners' legal, written permission for commercial on-location work. Fees for obtaining Permits, any legal documentation required, and owners property usage fees are the responsibility of the client and will be added to the commercial invoice cost. In no case will Hilsdon Photography LLC be liable for the cost of permits, usage fees or legal documentation.
Special terms and conditions that apply to Wedding photography contracts: A Non-Refundable Deposit equal to 40% of the total wedding photography package price is required upon signing your contract with us. 40% Deposit for weddings may be either made by a Bank Cashier's check or secured on a major credit card. 2 weeks notice is required for cancellation of wedding photography contracts. In the event of extraordinary circumstances or a catastrophic event, those individual circumstances will be reviewed by the business owner on a case-by-case basis.
Deposits will not be refunded in the event that a wedding is cancelled due to the marriage ceremony not taking place.
POLICY CONCERNING GIVING CD'S OF IMAGES Please note that it is our policy NOT to give out CDs of entire photoshoots. As professional photographers we must protect the quality and integrity of our copyrighted products. Clients will receive a selected number of "finished" images depending on the photography packgage purchased. In all cases, a "proof" gallery of all the raw images from the shoot will be maintained indefinitely on a private, password protected gallery on our website, our clients can access them anytime. This archive is included in the price of the package.If the client agrees; a public gallery of images with a brief biography of the client will appear on our website, enabling them to have a web presence. A signed release will include this permission before any photo goes live on our website.
HILSDON PHOTOGRAPHY LLC PRIVACY POLICY:
We maintain strict physical, electronic and procedural safeguards to protect our customer information.
We do not sell or rent customer financial information to third parties.
We do not share customer email addresses or phone numbers with third parties or rent them to lists.
CLIENT SAFETY AND SECURITY Hilsdon Photography LLC is committed to providing a safe, comfortable and professional environment for our clients. Protecting our clients privacy, safety and security at all times while onsite in our home studio or on location is our #1 priority. We ask all clients to follow these common sense personal safety rules, especially when meeting people they do not know for the first time. (1) When meeting someone you don't know for the first time, please select a public venue and tell someone where you are going and what time you expect to return. (2) Bring a trusted friend or family member over the age of 18 with you to your photo appointment. (3) Call someone and let them know when you have arrived at your appointment and when you depart your photo appointment. (4) If you ever feel unsure or uncomfortable of your surroundings, trust your instincts and act on them. Hilsdon Photography LLC, its photographers and interns, will never engage in any form of harassment or other unlawful activity. We pride ourselves in providing a professional atmosphere where client privacy is respected; we are bound to uphold the law and engage in ethical conduct.
PHOTO RETOUCHING POLICY Hilsdon Photography LLC will do basic photo retouching on the images the clients select as their "finished" final images as a part of their package. Photo retouching is limited to BASIC photo adjustments for correcting minor skin flaws such as minor acne flare ups and/or other minor skin issues as requested by the client; slight whitening of the teeth (if needed), removing redness from the eyes (if needed) and very basic skin smoothing. Photographer will also retouch images to remove "fly-away" hairs affecting the integrity of the image. The Photographer will NOT engage in any image alteration that creates the illusion of weight loss, creates the illusion of body part reshaping or the illusion of body part enhancement. In addition, the photographer will not use photoshop to create false representation of clients. Photoshop is intended for image finishing to make print-ready ONLY.
PRINT REPLACEMENT POLICY:
Hilsdon Photography LLC guarantees the quality of our printed products purchased from our website shopping cart and stands behind them 100%. If for some reason you are not 100% satisfied with your printed products ordered from our website, you are entitled to a free replacement set of color-corrected prints at no charge to you. This replacement policy only applies to printed products ordered from the Online Shopping Cart on the Hilsdon Photography LLC website. This policy does NOT apply to prints made from our photographs produced by other retailers (for example: if you take a disc of our photographs to another retailer such as Ritz Camera or Costco for printing). Only printed products ordered on the website at http://www.hilsdonphoto.com are eligible for this guarantee.
HILSDON PHOTOGRAPHY LLC - REQUIREMENT FOR PHOTO RELEASE OR MODEL RELEASE -
REQUIREMENT FOR MODEL / PHOTO RELEASE SIGNATURE:
Hilsdon Photography LLC requires all customers to sign either a model or photo release, depending on the usage of the photos, an additional contract will be required for allowing commercial use of the images. By entering into a contract with us (securing our professional photography services) you agree to abide by the terms and conditions found on your model release and the terms and conditions presented on this page.
PHOTO RELEASE: SPECIAL NOTICE CONCERING PERSONS UNDER 18 YEARS OF AGE: A parent or guardian will absolutely be required to be present at all times during the minor's photo appointment. A parent or guardian must sign the model or photo release stating their permission to photograph the minor child. No photography of minors will take place unless these two conditions are upheld. Hilsdon Photography LLC will absolutely report any suspected exploitation of minors (or others) to the appropriate legal authorities and reserves the right to do so without impunity. Hilsdon Photography LLC enforces a "CONSERVATIVE DRESS" policy concerning photography of minor children: No more than 25% of total body skin area (arms, legs, torso) will be exposed and/or showing in photographs of under 18 persons. In the case of newborns or infant children in diapers this policy is amended to reflect appropriateness of subject. Minor children will not be photographed wearing inappropriate, profane, provocative, or "skimpy" clothing creating the illusion of making said minor children appear older than age 18, or otherwise deemed to be unwholesome in appearance by the photographer. Our conservative dress policy for minors is strictly enforced for liability and ethics reasons.
